Terms and Conditions of Service

Legacy Property Services
Effective Date: 13 May 2025

These Terms and Conditions (“Terms”) apply to all services provided by Legacy Property Services (“we”, “us”, “our”) to private clients, organisations, landlords, tenants, probate representatives, estate administrators, Court of Protection clients, deputies, attorneys, and other authorised representatives.

By instructing Legacy Property Services, you agree to these Terms.

1. About Legacy Property Services

Legacy Property Services provides professional property-related services including, but not limited to:

  • Property inspections

  • Property management support

  • Property maintenance coordination

  • Property condition reporting

  • Probate property support

  • Court of Protection property support

  • Property services for private clients

  • Services for organisations and professional bodies

  • Property visits, assessments, and administrative support​

The specific services provided will depend on the agreed scope of work confirmed with each client.

2. Definitions

For the purposes of these Terms:

“Client” means the person, organisation, representative, or authority instructing Legacy Property Services.

“Property” means any residential, commercial, or other premises relating to the services provided.

“Authorised Representative” means any person legally permitted to act on behalf of another individual or organisation, including executors, deputies, attorneys, solicitors, trustees, or appointed representatives.

“Services” means the work agreed between Legacy Property Services and the Client.

3. Client Instructions and Authority

Clients must provide accurate and complete information required for us to deliver services.

Where a person acts on behalf of another individual, including:

  • Probate estates

  • Deceased persons’ estates

  • Court of Protection clients

  • Vulnerable individuals

  • Organisations

the Client confirms that they have the necessary authority to instruct Legacy Property Services.

We may request evidence of authority where appropriate.

4. Scope of Services

The services provided will be based on the agreed instruction, quotation, proposal, or service agreement.

  • Legacy Property Services will:

  • Carry out services with reasonable care and skill

  • Communicate appropriately with clients and authorised representatives

  • Provide updates where agreed

  • Maintain professional standards​

Unless specifically agreed in writing, Legacy Property Services does not provide:

  • Legal advice

  • Financial advice

  • Probate administration services

  • Court of Protection legal services

  • Property valuation services requiring a regulated valuer

  • Building surveys or structural surveys.  

Clients should obtain specialist advice where required.

5. Probate Property Services

Where Legacy Property Services assists with probate-related properties, our role may include:

  • Property visits

  • Property condition reports

  • Securing properties

  • Maintenance coordination

  • Clearance coordination

  • Contractor liaison

  • General property support​

We do not act as executors, administrators, or legal representatives unless separately appointed in writing.

The Client remains responsible for obtaining appropriate legal authority and instructions relating to the estate.

6. Court of Protection Services

Where services involve Court of Protection clients, Legacy Property Services may work with:

  • Court-appointed deputies

  • Attorneys

  • Solicitors

  • Families

  • Care professionals

  • Other authorised representatives

We will only act on authorised instructions.

We recognise that some clients may require additional care and confidentiality, and we will handle information and communication appropriately.

7. Organisation and Corporate Clients

Where we provide services to organisations, including:

  • Housing providers

  • Charities

  • Local authorities

  • Professional firms

  • Corporate clients

Additional service agreements may apply.

The organisation remains responsible for:

  • Providing accurate instructions

  • Confirming authority to act

  • Providing access arrangements

  • Meeting agreed payment obligations

8. Access to Properties

Clients must ensure safe and lawful access to properties where services are required.

We are not responsible for delays caused by:

  • Lack of access

  • Incorrect keys or access information

  • Occupier refusal

  • Unsafe conditions

  • Circumstances outside our reasonable control

Where necessary, additional charges may apply for failed visits or repeat attendance.

9. Contractors and Third Parties

Legacy Property Services may recommend or coordinate third-party contractors.

Unless otherwise agreed:

  • Contractors remain responsible for their own workmanship

  • Clients may enter separate agreements with contractors

  • Legacy Property Services is not responsible for contractor performance outside our direct control

We will take reasonable care when selecting or coordinating service providers.

10. Quotations and Fees

Fees will be agreed before work begins wherever possible.

Fees may include:

  • Service charges

  • Inspection fees

  • Administration fees

  • Contractor coordination fees

  • Travel expenses where applicable

  • Additional work outside the original scope

All fees must be paid according to the agreed payment terms.

11. Payment Terms

Invoices must be paid within the agreed payment period.

If payment is not received, we may:

  • Suspend services

  • Require payment before further work

  • Recover reasonable costs associated with unpaid invoices

For probate and estate clients, invoices may be addressed to the authorised estate representative unless otherwise agreed.

12. Cancellation and Changes

Clients may cancel or amend services by providing reasonable notice.

Where work has already been completed, payment may still be required.

We reserve the right to cancel services where:

  • Instructions are unclear

  • Required authority cannot be confirmed

  • Payment obligations are not met

  • A property presents an unacceptable safety risk

  • Continuing the service would breach legal or professional obligations

13. Client Responsibilities

Clients agree to:

  • Provide accurate information

  • Inform us of relevant changes

  • Provide necessary permissions

  • Treat staff and contractors respectfully

  • Maintain safe access arrangements

  • Pay agreed fees

14. Confidentiality

Legacy Property Services respects client confidentiality.

We will keep information confidential except where:

  • Disclosure is required by law

  • Disclosure is necessary to provide services

  • Disclosure is made to authorised representatives or professionals involved in the matter

This includes information relating to:

  • Probate matters

  • Court of Protection clients

  • Private individuals

  • Organisations

  • Property circumstances

15. Data Protection and Privacy

Legacy Property Services processes personal information in accordance with applicable UK data protection legislation.

Our Privacy Policy explains:

  • What information we collect

  • How we use information

  • How information is protected

  • Client rights regarding personal data

16. Liability

Legacy Property Services will provide services with reasonable care and skill.

We are not responsible for losses caused by:

  • Incorrect information provided by clients

  • Delays caused by third parties

  • Events outside our reasonable control

  • Existing property defects not identified through agreed services

  • Actions taken independently by contractors or other parties

Nothing in these Terms limits liability where doing so would be unlawful.

17. Health and Safety

We reserve the right to refuse or stop work where conditions are unsafe, including:

  • Dangerous structures

  • Hazardous materials

  • Unsafe access

  • Aggressive behaviour

  • Serious health risks

We will notify the Client where possible.

18. Complaints

We aim to provide a professional and reliable service.

We will review complaints fairly and aim to respond within a reasonable timeframe.

19. Intellectual Property

Reports, photographs, documents, and materials produced by Legacy Property Services remain our intellectual property unless otherwise agreed.

Clients may use documents provided to them for the purpose for which they were commissioned.

20. Force Majeure

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including:

  • Extreme weather

  • Government restrictions

  • Emergencies

  • Third-party failures

  • Access issues

21. Changes to These Terms

We may update these Terms from time to time.

The version applicable at the time services are instructed will apply unless otherwise agreed.

22. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales.
